Zoning By-laws

Information about the three zoning by-laws that are used in Oakville.

A zoning by-law implements the policies of an official plan. It regulates how land and buildings are used, the location of buildings, lot coverage, building heights and other provisions necessary to ensure proper development.

In Oakville, there are currently three comprehensive zoning by-laws in effect.

Zoning By-law 2014-014 is the comprehensive zoning by-law applying to all properties in Oakville south of Dundas Street and north of Highway 407.

It is the rule book controlling how land and buildings are used, the location of buildings on a lot, building heights, and other provisions necessary to ensure proper development.

It was developed through the inZone project, which was in place from October 2011 to February 2014, and implements the policies of the  Livable Oakville Plan. Remaining lands in Oakville are covered by the North Oakville Zoning By-law 2009-189, as amended.

Zoning By-law 2014-014 was passed by Council on February 25, 2014, and partially deemed in force by the Ontario Municipal Board on February 23, 2015. Since then, additional sections have been deemed in force by the Board. Certain sections of the by-law are not yet in force, as noted throughout the document. Properties or regulations under appeal are covered with a blue tone. On these matters, compliance with both Zoning By-law 1984-63 and Zoning By-law 2014-014 is required.

Zoning By-law 1984-063 was the town's main comprehensive zoning by-law for properties south of Dundas Street and north of Highway 407.

It was repealed and replaced by Zoning Bylaw 2014-014, which was passed by Council on February 25, 2014 and partially deemed in force by the Ontario Municipal Board (OMB) on February 23, 2015. Additional sections of Zoning By-law 2014-014 have since been deemed in force.

Certain properties and regulations in Zoning By-law 2014-014 remain subject to appeals. While those appeals remain active, selected provisions of Zoning By-law 1984-063 remain in effect. As such, compliance with the relevant provisions of both Zoning By-law 1984-063 and Zoning By-law 2014-014 will be required until the related appeals are disposed of by the Ontario Municipal Board. Applicants who do not comply with one or both by-laws will require relief from those by-laws.
