Description

The original purpose of town initiated By-law 2021-021 was to amend the Zoning By-law 2014-014 in order to permit a residential building with a maximum height of six storeys and underground parking on Parcel 7 of the Former Public Works Site in accordance with Livable Oakville Part E: Growth Areas, Special Policy Areas and Exceptions Policy 21.6.5. A revised version of By-law 2021-021 passed on February, 8, 2021 did not include a cap on the number of storeys. A further amendment to the Zoning By-law (By-law 2021-154) was passed on December 22, 2021 and is subject to appeal by The Ashton Inc.

The Town has been requested to consider a settlement of the appeal to By-law 2021-154 that would authorize a 9 storey building complying with the 31 metre height limits set through by-law 2021-021 with three storeys subject to bonusing. An option for allowing additional height in the form of an elevator shaft has also been requested.

PLEASE NOTE:  Since the appeal period for By-law 2021-021 and By-law 2021-154 has passed there are no further appeal rights. The ability of individuals to participate in the Ontario Land Tribunal process will be determined in accordance with section 34(24.1) of the Planning Act.

By-law 2021-154 has been appealed to the Ontario Land Tribunal. Case number OLT-22-002121.
